Bulldogs moving Co. contract Terms & Conditions

This Contract Terms and Conditions Agreement (this “Agreement”) is hereby entered into by Bulldogs Moving
Co. (the “Company”) and undersigned (the “Customer”). The Parties agree as follows:

1. Rates. Company shall charge its time in fifteen-minute increments (0.25 of an hour). Company may add other charges to the quote in addition to the hourly rate. The Customer shall pay all charges as discussed or as listed on the quote for services provided upon completion of the move.

2. Initial Deposit. Prior to Company beginning services, Company shall require a fifty to a hundred dollar ($50.00-$100.00) deposit for local moves and a twenty to fifty percent (20%-50%) deposit for out-of-state moves or longer distance moves from the Customer to secure the date and time for services to begin and be performed by Company, and shall be refundable only upon Customer providing Notice of Cancellation by email to bulldogsmovingco@gmail.com within 24 hours from time and date of Customer’s payment of deposit.

3. Billing & Payments. Company will provide the Customer with an itemized statement of expenses incurred after completion of the services rendered by Company, specifically but not limited to its performance of moving services and all related services performed by Company agents and/ or employees. Payment for all invoices is due upon receipt of the invoice. It is expected and agreed that the Customer will review his or her itemized billing statement upon receipt. Specific objections to the billing statement must be submitted in writing within 30 days of the date on the statement or the statement is deemed accepted and shall stand as is.

4. Past Due Amounts / Interest Charged on Balance. Interest shall accrue beginning thirty (30) days after the date of all invoices at an annual rate of eight percent (8%) if payment is not received within 30 days of the invoice. Customer also agrees to pay for all collection costs, including employee time and expense and all attorneys’ fees and costs Company incurs in either collection of and/or protection of its interests in Customer’s past due account or performance of this Agreement.

5. Hold Harmless: Customer agrees to hold Company harmless in connection with the work described herein and that liability under this Agreement shall be limited to, the amount Company billed to Customer.

6. Forum Selection. Any legal action or proceeding with respect to this Agreement or the services provided hereunder or for recognition and enforcement of any judgment in respect hereof brought by the either party to this Agreement hereto or its successors or assigns must be brought and determined in the state courts of Indiana or the United States District Courts for Indiana, and each party hereto submits with regard to any action or proceeding for itself and in respect of its property, generally and unconditionally, to the sole and exclusive jurisdiction of the aforesaid courts.

7. Waiver and Release. Bulldogs Moving Co., LLC is NOT responsible for the following:
(a) Damages to items in boxes / totes that we did not pack, particle board furniture, or structurally frail furniture.
(b) Disconnecting/connecting anything including, but not limited to: appliances, electronics, wall mounts, light fixtures, etc.; Company recommends hiring professionally licensed persons for such tasks. If asked to perform work, Company is not responsible for damages created by performing the task.
(c) Items moved in / out of storage facilities, trailers, rental trucks, etc. by another company or the Customer. All damages that occur by others that are not working for Company.
(d) High risk / bulky items including but not limited to gun safes, exercise equipment, filing cabinets, large furniture items that do not fit that the customer asks to be moved up or down stairs, or through tight areas, Customer acknowledges the excess risk of moving said items and agrees to not hold Company liable for any damages to item, property, or persons by attempting to move.
(E) Home repairs including scratched flooring, wall / ceiling damage, or cleaning services for mud / dirt tracked in during the move.

I acknowledge that packing, loading, transporting, unloading, and unpacking creates certain risks to my items, property, and my person. In particular, property can be broken dropped, scraped, torn, scratched, lost, etc.; including risks to carpets, hardwood flooring, walls, trim, rails, doors, etc.; as well as risk of loss over-the-counter medications, damage to fur, or items lined with fur, particle furniture, and electronics. Bulldogs Moving Co., LLC strongly recommends that you move items of significant monetary or personal worth on your own and in your own vehicle, such as, but not limited to: TVs, electronics, jewelry, furs, personal collections, picture albums, etc. Please note that Company will not move firearms, ammunition, explosives, or any other hazardous / dangerous items / materials. Further, I could be physically injured by use of property damaged in the move, or through physical impact with furniture, boxes, or vehicles.

I understand that disconnecting / connecting from / to the home / apartment / office is my personal responsibility and is not part of services offered by Company. I understand items, including but not limited to: furniture, beds, bunk beds, mirrors, playsets, trampolines, washers, dryers etc. that are disassembled / assembled are my responsibility to inspect upon completion and agree to not hold Company responsible for any damages that occur after completion.
I, for myself, my heirs, successors, executors, and subrogates, hereby knowingly and intentionally waive and release, indemnify and hold harmless Company, its directors and employees from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorney’s fees) for damages to my items, property, and/or person resulting from Company’s negligence during the move. I acknowledge Company is only responsible for $0.60 per pound of damaged or missing items. I agree that I may not bring any claim for lost or damaged items more than seven (7) days after the move. By bringing a claim, I agree to permit Company any reasonable means to investigate my claim. Company’s responsibility only extends to items while under its care and terminates when it leaves the premises.
